The application of the burden of proof in direct discrimination claims has been explained in a number of cases, most notably in the guidelines annexed to the judgment in Igen Ltd v Wong [2005] ICR 931 CA. In that case, the Court was considering the previously applicable Case Number: 3304139/2023 10 provisions of s.63A of the Sex Discrimination Act 1975, but the guidance is still applicable to the equivalent provision of the EQA. 25.
